Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications and services (collectively, the "Services") provided by Watni Digital ("we," "us," or "our"), a company registered in Pakistan. By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing or using any of our Services, you acknowledge that you have read, understood and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use our Services.

2. User Accounts

To access certain features of our Services, you must create an account. When creating an account, you agree to:

• Provide accurate, current and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

3. Subscription & Billing

Some of our Services are available on a subscription basis. By subscribing to a paid plan, you agree to the following:

• Billing Cycle: Subscriptions are billed on a monthly or annual basis as selected at the time of purchase. Billing occurs at the start of each billing period.
• Payment: You authorize us to charge your selected payment method for the subscription fees. All fees are quoted in the currency displayed at checkout (PKR or USD).
• Renewals: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Price Changes:We may change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
• Refunds: We offer refunds in accordance with our refund policy. Generally, refunds are available within 14 days of the initial purchase for annual plans. Monthly plans are non-refundable.

4. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not:

• Use the Services in any way that violates any applicable local, national or international law or regulation.
• Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems or networks connected to the Services.
• Upload, transmit or distribute any viruses, malware or other harmful code.
• Use the Services to send unsolicited communications, spam or bulk messages.
• Interfere with or disrupt the integrity or performance of the Services.
• Reverse engineer, decompile, disassemble or attempt to derive the source code of the Services.
• Resell, sublicense or redistribute the Services without our prior written consent.

5. Data Ownership

You retain ownership of all data, content and materials that you upload, submit or store through our Services ("Your Data"). By using our Services, you grant us a limited, non-exclusive license to use Your Data solely for the purpose of providing and improving the Services.

We do not sell, share or use Your Data for advertising purposes. Upon termination of your account, you may request an export of Your Data. We will make Your Data available for export for 30 days following account termination, after which it may be permanently deleted.

6. Intellectual Property

The Services and all associated content, features, functionality, designs, source code, trademarks and branding are and remain the exclusive property of Watni Digital. Nothing in these Terms grants you any right to use our trademarks, logos, domain names or other brand features without our prior written permission.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
• We do not warrant that the Services will be uninterrupted, error-free, secure or free from viruses or other harmful components.
• In no event shall Watni Digital, its directors, employees, partners or agents be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or other intangible losses arising out of or in connection with your use of the Services.
• Our total aggregate liability for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

8. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or through your account settings.

Upon termination:

• Your right to access and use the Services will immediately cease.
• You may request an export of Your Data within 30 days of termination.
• Any outstanding fees owed to us become immediately due and payable.
• Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, limitation of liability and dispute resolution.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Pakistan. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Pakistan.

Before initiating any legal proceedings, you agree to first attempt to resolve the dispute informally by contacting us. We will make reasonable efforts to resolve any dispute within 30 days of receiving your notice.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
